SECTION 1 – ONLINE STORE TERMS

By purchasing alcohol through this website, you confirm that you are aged 18 years or over.

We operate a strict Challenge 25 policy where appropriate and reserve the right to carry out age verification checks before accepting or dispatching an order. Deliveries containing alcohol may require proof of age upon delivery. If suitable identification cannot be provided, delivery may be refused and your order cancelled.

You agree not to use our website or purchase products for any unlawful purpose or in breach of any applicable laws or regulations.

You must not knowingly introduce viruses, malware or any other malicious software which could interfere with the operation or security of this website.

We reserve the right to suspend or terminate access to our website where these Terms have been breached.

We reserve the right to refuse service, cancel orders or restrict access to our website where we reasonably believe it is appropriate to do so.

All payment information is securely processed by Shopify and our authorised payment providers. We do not store your full payment card details.

From time to time there may be typographical errors, pricing mistakes or inaccuracies. We reserve the right to correct such errors at any time without prior notice, including after an order has been placed.

SECTION 4 – PRODUCTS, PRICING & AVAILABILITY

Many of our beers are produced in limited batches and seasonal releases. Availability cannot be guaranteed.

All product photographs are provided for illustrative purposes only. Bottle labels, can artwork, packaging and presentation may vary from those shown.

Every effort has been made to display product colours accurately, although colours may differ depending on your screen or device.

All prices displayed are in Pounds Sterling (£) and include VAT where applicable unless otherwise stated.

Prices, promotions and product availability may change without notice.

We reserve the right to limit quantities purchased or refuse orders where we reasonably believe products are being purchased for unauthorised resale.

SECTION 5 – ORDERS

Submitting an order through our website constitutes an offer to purchase goods from First & Last Brewery.

Receipt of an order confirmation email does not constitute acceptance of your order. Acceptance occurs only when your order has been processed and dispatched.

Should we be unable to fulfil your order for any reason, including stock shortages, pricing errors or failed age verification, we will notify you as soon as reasonably possible and provide a refund where payment has already been taken.

We reserve the right to cancel or refuse any order at our discretion.

SECTION 6 – PAYMENT

Payment must be made in full before goods are dispatched.

We accept payment using the methods displayed during checkout.

You agree to provide accurate billing, delivery and contact information when placing an order and to keep these details up to date.

Should fraudulent activity be suspected, we reserve the right to delay or cancel an order while appropriate checks are carried out.

SECTION 7 – DELIVERY

Delivery estimates provided on this website are intended as guidance only and are not guaranteed.

Risk in the goods passes to you upon successful delivery.

Ownership of the goods remains with First & Last Brewery until payment has been received in full.

Please inspect your order upon delivery. If goods are damaged, missing or incorrect, please notify us within 48 hours so we can investigate and resolve the issue.

Delivery may be refused where age verification cannot be satisfactorily completed.

SECTION 8 – RETURNS & REFUNDS

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible so that we can arrange an appropriate resolution.

Due to the nature of food and drink products, we cannot normally accept returns simply because you have changed your mind, unless required by applicable consumer legislation.

Nothing contained within these Terms affects your statutory rights under UK consumer law.

Unless otherwise stated:

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • discount codes cannot be applied retrospectively;

  • discount codes may exclude certain products;

  • we reserve the right to withdraw or amend promotions at any time.

Any attempt to misuse promotional offers may result in orders being cancelled.

SECTION 18 – GIFT CARDS (Where Available)

Gift cards purchased through our website are non-refundable and cannot be exchanged for cash unless required by law.

Gift cards should be treated like cash. We are unable to replace lost, stolen or damaged gift cards.

Gift cards may only be redeemed through our official online store unless otherwise stated.

Subject to the above, First & Last Brewery shall not be liable for any indirect, consequential or economic loss arising from the use of this website or the purchase of products through it.

Our total liability in connection with any order shall not exceed the amount paid for the relevant products.

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to severe weather, flooding, fire, industrial disputes, transport disruption, supplier failure, power outages or government action.

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision shall be deemed severed from the remaining Terms.

The remainder of these Terms shall continue in full force and effect.

SECTION 23 – WAIVER

Failure by First & Last Brewery to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision at a later date.

SECTION 24 – TERMINATION

We reserve the right to suspend or terminate your access to this website without notice where we reasonably believe these Terms have been breached.

Termination shall not affect any rights or obligations that have arisen before termination.

SECTION 25 – ENTIRE AGREEMENT

These Terms & Conditions, together with our Privacy Policy, Delivery Policy and Refund Policy, constitute the entire agreement between you and First & Last Brewery regarding your use of this website and any purchases made through it.

They supersede any previous agreements, understandings or representations relating to the website.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
